Terms of Use
Last updated: 14 October 2026
By using CINECLUB (the "app"), you agree to these terms. CINECLUB is currently a free film-club service, provided by Lewis Fowler, trading as CINECLUB. Contact: hello@thecineclub.co.uk. Postal address: Clyde Offices, 48 West George Street, Glasgow, G2 1BP.
1. Who can use CINECLUB
You must be 13 or over to use CINECLUB. If you are under 18, please check with a parent or guardian before you sign up. I do not knowingly allow accounts for children under 13, and I will delete any I find.
2. The service
CINECLUB is provided "as is" and free of charge, with no guarantee of availability, uptime, or that your data will not be lost. It may change, break, or shut down at any time. I will give reasonable notice before shutting it down permanently if I can.
Payments and refunds. CINECLUB takes no payments at present, so there is nothing to refund. If I add paid features, I will show the price, any renewal, and how to cancel and get a refund before you pay. Nothing in these terms affects your legal rights as a consumer.
3. Your licence to use CINECLUB, and ownership
I give you a personal, non-exclusive, non-transferable licence to use CINECLUB, for your own non-commercial use, on devices you own or control. The licence ends when your access ends (see section 9).
Except where the law or an open-source licence allows it, you must not:
- copy or modify CINECLUB, or make anything based on it;
- reverse engineer or decompile CINECLUB, or try to get its source code;
- rent, sell, lend, sublicense or transfer CINECLUB, or your licence to use it, to anyone else.
The code, design and logo of CINECLUB belong to me or my licensors. Open-source parts of CINECLUB stay under their own licences. Film information belongs to its providers (see section 10), and what you post stays yours (see section 4). I keep every right that these terms do not expressly give you.
4. Your content
You are responsible for the club names, display names, film entries, chat messages, reviews, comments, replies, reactions and ideas-board posts you submit. You keep ownership of what you write. You grant me permission to store and display it within the app in order to run the service.
5. Content that is not allowed
Do not post, upload or share anything that:
- is illegal under applicable law, or encourages or assists a criminal offence;
- is threatening, abusive, harassing, or is intended to cause distress to someone;
- stirs up hatred against people because of race, religion, sex, sexual orientation, disability, gender identity or any other protected characteristic;
- sexually exploits or endangers a child, or is sexual content involving anyone under 18;
- is an intimate image of someone shared without their consent;
- encourages suicide, self-harm or an eating disorder;
- is pornographic, encourages dangerous challenges or harmful substance use, or promotes serious violence or animal cruelty. Discussing a film's themes or seeking support is different from encouraging harm;
- promotes terrorism, or the sale of weapons or controlled drugs;
- is fraudulent, or is used to trick someone out of money or personal information;
- infringes someone else's copyright, trade mark or other rights, including sharing pirated films or links to them;
- is someone else's personal information posted without their agreement.
This list is not exhaustive. If content is illegal, it is not allowed here, whether or not it appears above.
Some non-pornographic film metadata may be classed as incidental mature content because it refers to strong sex, nudity or similar themes. It is hidden by default. A saved account may enable that setting on the CINECLUB website; the saved choice can then apply in the installed app. Explicit pornography, sexual exploitation, child sexual content, non-consensual intimate imagery and other prohibited material are always blocked and cannot be enabled.
6. Acceptable use
Do not abuse, attack, scrape, overload, or attempt to break the app or its security. Do not use it to harm or harass other people. Do not impersonate someone else. Do not use automated tools to create accounts or clubs.
7. Reporting content, and what I do about it
A basic word filter checks reviews, comments, replies, chat messages, club and display names and ideas-board posts before they are saved. It cannot recognise every harmful message or judge its context. You can also use the block button beside a post to hide that member's chat messages, reviews, comments and replies from your view in the club. To undo this, use their blocked label in the club's member list. Blocking does not remove them from the club or stop them seeing your posts; report conduct that needs my intervention.
If you see content in CINECLUB that breaks section 5, or that you believe is illegal or unsafe, report it to me:
- Use Report beside an ideas-board feature or bug post. It opens the private report form with a reference to that post.
- Use the Feedback button in the app and choose "Report content or a safety concern". This is the fastest route, because it tells me which club you were in.
- Use the small ⋯ (More actions) beside a chat message, review or comment, then choose Report. On a phone you can also press and hold the post. A reply has its own small ⋯ report button. The form includes a reference and short quote to help me locate the content.
- Use the Report link on a conversation: at the top of the club chat, under a film's reviews, or beside its discussion. The form then includes the most recent posts from other members, each with a reference and a short quote.
- Or email hello@thecineclub.co.uk with "Report" in the subject line. Tell me the club code, the film, and what the content says, so I can find it. This address is also my single point of contact for users and for authorities, including under the EU Digital Services Act.
When I receive a report:
You can read private replies through the app while you retain access to the account or guest session used to report. Include an email address if you need another way to receive a reply. Your report goes privately to the service owner, including if it concerns a club administrator.
- I aim to acknowledge it within 2 working days. That acknowledgement confirms that I have received your report.
- I review the actual content and decide as soon as reasonably practicable. If I have reason to believe content is illegal, I take proportionate steps to minimise how long it remains and remove it swiftly, without waiting for a routine response target.
- I may remove the content, remove a member from a club, or suspend or delete an account. Where I have a way to contact the author of content I remove or restrict, I tell them what I did and why, and how to ask me to look again.
- I tell the reporter the outcome where I can do so safely. If you disagree with my decision, reply and say so, and a person will look at it again.
Club conversations are available to that club's members and, where necessary, authorised service administration and providers. Approved Ideas-board posts are shared across clubs; private feedback and reports are not published there. If someone outside a club needs to report a concern, email me with enough information to locate it.
Copyright complaints. Email hello@thecineclub.co.uk with the work concerned, the location of the content, why you believe its use is unauthorised, your contact details and your signature (which may be electronic). For a US DMCA notice, also include a good-faith statement that the use is not authorised by the rights holder, its agent or law, and a statement that your information is accurate and, under penalty of perjury, that you are authorised to act. I review notices and any lawful counter-notices. I may terminate accounts used for repeated copyright infringement in appropriate circumstances. This contact is not a claim that a US Copyright Office designated-agent registration has been completed.
8. Reporting child sexual abuse material
If you find child sexual abuse imagery or grooming content in CINECLUB, do not download or forward it. Report it to me immediately. If a child is in immediate danger, contact your local emergency services (999 in the UK). You can also report suspected online child sexual abuse images or videos to the Internet Watch Foundation. I will preserve only what is necessary and seek the appropriate law-enforcement guidance.
9. Suspension, ending your use and removal
I may remove content or revoke access if you break these terms, if the law requires it, or if keeping the content would put other members at risk. Where it is reasonable to do so, I will tell you why, and you can appeal by email.
You can stop using CINECLUB at any time, and you can delete your account yourself from Account in the app. When your access is removed or your account is deleted, your licence to use CINECLUB ends. The Privacy Policy explains what happens to your data and to what you wrote. The parts of these terms that are meant to carry on, such as what I own (section 3), liability (section 12) and governing law (section 14), do.
10. Film data
Film posters, metadata and where-to-watch information come from The Movie Database (TMDB) and JustWatch. This product uses TMDB and the TMDB APIs but is not endorsed, certified, or otherwise approved by TMDB. Those providers' rights remain their own. CINECLUB does not host, stream or provide pirated film files. Links to trailers and viewing services do not give you a licence to show a film publicly; check the rights needed for any screening you organise.
11. Privacy
How I handle your personal data, and how to complain about it, is set out in the Privacy Policy.
12. No warranty and liability
I aim to provide CINECLUB with reasonable care and skill. I cannot promise uninterrupted availability or that third-party film information is always accurate. My responsibility for loss or damage is determined by applicable law, including your mandatory consumer rights.
Nothing in these terms limits or excludes my liability for death or personal injury caused by my negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded under applicable law. If you use CINECLUB as a consumer, you keep all the rights the law of the country where you live gives you, including any rights about the quality of a digital service, and nothing here takes them away.
13. Complaints
To complain about anything other than content (for example a decision I made, or the service itself), email hello@thecineclub.co.uk. I aim to acknowledge within 5 working days and investigate without undue delay. Data protection complaints follow the process in the Privacy Policy.
14. Changes and governing law
I may update these terms. I will give appropriate notice of significant changes before they take effect, unless a legal or urgent security reason requires an earlier change. Where the law requires your agreement, I will obtain it; publishing a change alone does not supply that agreement. These terms are governed by the laws of Scotland. If you live elsewhere in the UK or in another country, you keep any mandatory consumer protections of the place where you live and may bring proceedings in the courts available to you there. These terms are written in English. If I publish a translation, the English version decides any difference between them, except where applicable law requires otherwise.
15. General
These terms and the Privacy Policy are the whole agreement between you and me about CINECLUB. This does not take away any right you have under consumer law. If a court decides that part of these terms cannot be enforced, the rest still applies. If I do not enforce a right straight away, I have not given it up.
16. If you get CINECLUB from the Apple App Store
These extra terms apply only if you install CINECLUB from the Apple App Store. They add to the rest of these terms. If they conflict with the rest of these terms, they win for that installation.
- Who the agreement is with. These terms are between you and me only, not Apple. I, not Apple, am responsible for CINECLUB and what it contains.
- Where you can use it. Your licence is non-transferable. It covers any Apple-branded device that you own or control, as the usage rules in the Apple Media Services Terms and Conditions allow. Other accounts linked to yours through Family Sharing, volume purchasing or Legacy Contacts may also use it, as those rules allow.
- Support. I alone am responsible for any support and maintenance of CINECLUB. Apple has no duty to provide any.
- Warranty. If CINECLUB fails to meet a warranty that applies to it, you may tell Apple, and Apple will refund the purchase price of the app to you, if you paid one. To the maximum extent the law allows, Apple has no other warranty duty. I am responsible for any other claim, loss, liability, damage, cost or expense caused by a failure to meet a warranty.
- Claims. I, not Apple, deal with any claim by you or anyone else about CINECLUB or your use of it. That includes product liability claims, claims that CINECLUB does not meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar law.
- Intellectual property claims. If anyone claims that CINECLUB, or your possession and use of it, infringes their intellectual property rights, I, not Apple, am solely responsible for investigating, defending, settling and discharging that claim.
- Legal compliance. You confirm that you are not in a country or region that the US Government has embargoed or has designated as "terrorist supporting", and that you are not on any US Government list of prohibited or restricted parties.
- Third-party terms. You must follow any third-party terms that apply when you use CINECLUB, for example your mobile data or internet provider's agreement.
- Questions and complaints. Send any question, complaint or claim about CINECLUB to the email and postal address at the top of these terms.
- Apple's right to enforce. Apple and its subsidiaries are third-party beneficiaries of these terms. When you accept them, Apple can enforce them against you as a third-party beneficiary.
